NC Archives - Gates County Wills

In the name of God Amen. I, Isaac Pipkin of the County of Gates and State of North Carolina being weak of body but of sound and disposing mind and memory thanks be God do this 12th day of December In the Year of our Lord One Thousand eight hundred and Thirty seven constitute ordain and declare this Instrument to be my last Will and Testament hereby revoking and annulling all other wills by me heretofore made in manner and form following To wit

Imprimis. I Lend unto my beloved wife Mary Pipkin One third part of all the Lands of which I may die possessed with the exception of the Tract I bought of my Son John D. Pipkin which tract I leave and and give to be equally divided between my two Grand Children James Pipkin and Isaac Pipkin their and each of their heirs forever with the exception above specified I lend unto my wife before named one third of my Lands and also one third of my personal estate during her life.

Item. I give unto my beloved Daughter Martha Pipkin now by marriage Martha Smith one other third part of my Real as well as personal estate to her and each of her heirs forever.

Item. I Give and bequeath unto my beloved Son John D. Pipkin the remaining third both of my Real as well as personal estate to him and each of his heirs forever. Circumstances however induce in me the belief that he Contemplates a marriage in Mrs Penelope Parkers family of Va contrary to my wishes and memomtrances believing such marriage would not promote his well being or welfare. I feel that deep and abiding affection which justly and naturally characterizes a parent who endeavours to provide for the future welfare of his Son. Now therefore in case of his failure to make such marriage from his present aparances now given it is my intention & will that the above be a valid gift and in the event of his failure to comply with my wishes as before expressed that then and in that case I give the whole of that I have before given to him under conditions before specified to his two children and my two Grandchildren now living with me James Pipkin and Isaac Pipkin to them and each of their heirs forever.

After the death of my wife Mary Pipkin, I leave that part both of my Real as well as personal estate lent unto her during her life to be equally divided between my two children namely John D. Pipkin and Martha Smith subject however to the within reservations and conditions.

I nominate and appoint my Son John D. Pipkin and my Son in law Hennisy T. Smith to be Executors of this my last will and Testament In witness where of I have here unto set my hand and affixed my seal the day and date above written...
